These Terms & Conditions ("Terms") govern your access to and use of the KokanFresh website www.kokanfresh.in and all services, products, and content provided by KokanFresh (referred to as "we", "us", or "our") related to the sale and delivery of Premium Ratnagiri Alphonso Mangoes and related products.
By browsing, accessing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, please do not use our website or services.
1. Acceptance of Terms
By placing an order or using our services, you confirm your acceptance of these Terms. These Terms constitute a legally binding agreement between you and KokanFresh.
2. User Eligibility
Our services are available only to individuals who can form legally binding contracts under applicable law. By using our services, you represent that you are at least 18 years old and capable of entering into agreements.
3. Product Sales
- Product Descriptions: We strive to provide accurate product descriptions and images of our mangoes and related products. However, natural agricultural products may vary slightly in size, color, and taste.
- Pricing: All prices are listed in Indian Rupees (INR) unless otherwise specified and may change without prior notice. Taxes and delivery charges (if applicable) are displayed at checkout.
- Availability: Mango availability is seasonal and subject to harvest conditions. We reserve the right to limit order quantities per customer.
4. Payment and Refunds
All payments are processed securely through third-party payment gateways (e.g., Razorpay, PayPal, Stripe). By providing your payment details, you confirm that you are authorized to use that payment method.
- Billing Information: You agree to provide accurate and complete billing details.
- Refunds & Cancellations: Refunds are governed by our Refund & Cancellation Policy. Since mangoes are perishable, cancellations are only possible before dispatch. Damaged or spoiled products reported within 24 hours of delivery may be eligible for replacement/refund.
5. Delivery and Shipping
- Delivery Timelines: We aim to deliver orders within the estimated timeframe. However, delays may occur due to logistics or unforeseen conditions.
- Delivery Charges: Applicable delivery charges (if any) will be shown at checkout.
- Risk of Loss: Responsibility for products passes to you upon delivery. Please inspect your order at delivery and notify us of any issues immediately.
6. Warranties and Guarantees
KokanFresh guarantees that delivered mangoes will be fresh and of premium quality at the time of dispatch. However, since mangoes are natural perishable items, minor variations may occur. We disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose.
7. Limitation of Liability
To the fullest extent permitted by law, KokanFresh shall not be liable for any indirect, incidental, or consequential damages, loss of profits, or other intangible losses arising from the use or inability to use our services or products.
8. Intellectual Property
All content on the KokanFresh website, including text, images, logos, and graphics, is the property of KokanFresh or its content suppliers and protected by intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ratnagiri, Maharashtra, India.
